1. Acceptance of Terms

By downloading, installing, or using DASPR, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the application.

2. Description of Service

DASPR is a privacy-first personal finance application that provides users with a daily spending guidance number ("Daily Safe Spend") and tools to track financial health. DASPR allows users to:

• Calculate a daily spending limit based on income, expenses, and savings goals
• Track daily transactions
• Visualize financial health through various metrics and indicators
• Manage exceptions for larger expenses
• Build better financial habits through behavioral design elements

All financial data is stored locally on your device in accordance with our Privacy Policy.

3. User Accounts and Subscriptions

3.1 Account Registration

To use certain features of DASPR, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Subscription Services

DASPR offers premium features through subscription services managed through app stores. By subscribing to DASPR premium features:

• Subscriptions will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings in the app store after purchase
• No refunds will be granted for any partially used subscription periods

4. User Responsibilities

4.1 Account Security

You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.

4.2 Lawful Use

You agree to use DASPR only for lawful purposes and in compliance with all applicable laws and regulations.

4.3 Prohibited Activities

You agree not to:

• Use DASPR to engage in any illegal activity
• Attempt to gain unauthorized access to DASPR's systems
• Interfere with other users' use and enjoyment of DASPR
• Attempt to reverse engineer, decompile, or disassemble the application
• Use automated means to access or manipulate DASPR

5. Intellectual Property Rights

5.1 Ownership

DASPR and its original content, features, and functionality are owned by DASPR and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use DASPR for your personal, non-commercial use on devices that you own or control.

5.3 Restrictions

You may not:

• Copy, modify, or create derivative works of DASPR
• Use DASPR for commercial purposes
• Remove any copyright or other proprietary notices from DASPR
• Transfer, sublicense, lease, lend, rent, or otherwise distribute DASPR to any third party

The information provided by DASPR is for informational and educational purposes only and should not be construed as professional financial advice. While we strive to provide accurate calculations and information, we do not guarantee the accuracy, completeness, or usefulness of any information in DASPR. The app relies on user-provided information, and any inaccuracies in user input will affect the output.

6.3 "AS IS" and "AS AVAILABLE"

DASPR is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall DASPR, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use DASPR
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code that may be transmitted through DASPR
• Any content or information you submit or DASPR accesses with your permission
• Any other matter relating to DASPR

The total liability of DASPR for any claim arising out of or relating to these Terms or our Services, regardless of the form of the action, is limited to the amount paid, if any, by you to access or use DASPR during the 12 months immediately preceding the event giving rise to your claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless DASPR, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your use of DASPR
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any privacy right or intellectual property right
• Any claim that your use of DASPR caused damage to a third party

9. Modifications to the Service

We reserve the right to modify or discontinue, temporarily or permanently, DASPR or any features or portions thereof without prior notice. You agree that we will not be liable for any modification, suspension, or discontinuance of DASPR or any part thereof.

10. Updates to Terms of Service

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision, in our sole discretion, is material, we will notify you via the app or the email associated with your account. By continuing to access or use DASPR after revisions become effective, you agree to be bound by the revised terms.

11. Termination

We may terminate or suspend your account and access to DASPR immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use DASPR will immediately cease.

Upon account termination, we do not retain any of your financial data. We only retain the basic account information that you provided during account creation for record-keeping purposes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within Texas.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

14. Complete Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DASPR regarding DASPR and supersede all prior agreements and understandings, whether written or oral.

15. Data Backup

While DASPR offers backup functionality, you are responsible for maintaining your own backups of your financial data. We are not responsible for any loss of data, whether due to your actions, device failure, or any other cause.

16. Third-Party Services and Content

DASPR may integrate with third-party services, such as bank data providers. Your use of such services is subject to their terms of service and privacy policies. We are not responsible for the content or practices of these third parties.

17. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation.

18. Feedback

Any feedback, comments, or suggestions you may provide regarding DASPR is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.
